O impetrante, fundamentando-se na Constituição Federal de 1891, artigo 72, e no Decreto nº 19398 de 11/11/1930, artigo 3º, 4º e 5º, requereu que fosse impetrado habeas corpus em seu favor. Ele achava-se preso na Colônia Correcional de Dois Rios por incursão no Código Penal, artigo 294, aguardando transferência para a Casa de Correção. Alegou estar preso junto com vadios e capoeiras, em lugar assolado por epidemia da moléstia beri-beri. A ordem foi negada
