O suplicante, domiciliado em São Gonçalo, Niterói, portador de títulos de crédito da antiga Cia Estrada de Ferro Araraquara, tendo sido o acervo da massa falida da Cia Araraquara vendido à suplicada por pessoas de mais de 213 dos créditos reconhecidos na falência alegou que tal alegação não era exata, pois vários portadores de tais créditos jamais outorgaram poderes a L. Behrens und Soehne. Em virtude disto, requereu o suplicante a anulação judicial desta venda. O juiz deferiu a inicial. O réu agravou e o Supremo Tribunal Federal negou-se a dar o provimento ao agravo. O autor desistiu da ação.
