A autora, empresa nacional de utilidade pública no aeroporto Santos Dumont, alegou que pelo vapor Del Monte importou 255 tambores de óleo lubrificante confrontando as datas de importação e da fatura consular entendeu a Alfândega que a suplicante havia infringindo o artigo 5 do decreto 22717, impondo-lhe uma multa. A suplicante alegando que tal ato era ilegal requereu a restituição do valor de 58.612, 00 cruzeiros, indevidamente pago à Alfândega do Rio de Janeiro. A ação foi julgada procedente. O juiz recorreu de ofício, a União apelou e o TFR deu provimento a ambos. O autor interpôs Recurso Extraordinário que foi indeferida liminarmente
